FractalPay Terms and Conditions
Welcome to FractalPay. These Terms and Conditions govern your access to and use of the FractalPay Web Application, including all related features (e.g., Expense Tracker, Bill Payments, Visit Management) and the marketing website (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms.
IMPORTANT:
These Terms contain provisions concerning mandatory arbitration and a waiver of class action rights.
Terms and Conditions
1. Agreement to Terms
By using the FractalPay Service, you represent and warrant that you have the legal capacity to enter into this agreement and that you are 18 years of age or older. If you are using the Service on behalf of an entity, you warrant that you have the authority to bind that entity to these Terms.
2. Services and Scope
FractalPay provides a financial management platform designed to simplify payments and compliance between families/users and essential service providers (e.g., healthcare, education, therapy).
Limitations:
FractalPay is a payment facilitator and compliance tool, not a bank, credit union, or financial advisor.
We do not guarantee the availability of funds or the validity of services provided by third-party providers.
Any disputes regarding the underlying service (e.g., quality of care) must be settled directly with the relevant provider.
3. User Accounts and Responsibilities
Account Security:
You are solely responsible for maintaining the confidentiality of your account credentials (username and password). You must notify FractalPay immediately of any unauthorized use or security breach.
Prohibited Uses:
You agree not to use the Service for any unlawful or fraudulent purpose, including:
Attempting to defraud FractalPay or other users.
Engaging in any activity that violates Anti-Money Laundering (AML) or Counter-Terrorism Financing (CTF) laws.
Uploading viruses or malicious code.
4. Payment and Fees
Details regarding transaction fees, subscription costs (if applicable), and payment processing times are outlined on the dedicated [Pricing Page Placeholder] and will be disclosed at the time of transaction.
By initiating a payment through FractalPay, you authorize us to charge the designated payment source (bank account, card) for the total amount, including any applicable service fees.
5. Intellectual Property
All intellectual property rights in the Service, including the web application code, design, logos (FractalPay), and content on this website, are owned by or licensed to FractalPay and are protected by copyright laws.
Users retain ownership of their proprietary data (transaction logs, personal information) input into the system.
6. Disclaimer of Warranties and Limitation of Liability
Disclaimer:
The Service is provided on an "as-is" and "as-available" basis. FractalPay expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability:
FractalPay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use of the Service, even if FractalPay has been advised of the possibility of such damages.
